Terms & Conditions for Social Tournaments

  1. Organizer Information

This campaign is organised by GSH ONLINE MEDIA, headquartered in Romania, Bucharest, Nestorei 1, Sector 4, River Plaza Building.

  1. Eligibility Criteria

  • Only individuals who possess government-issued ID and are at least 18 years old can participate in this campaign. Legal entities, companies, etc., are excluded from participating.

  • If located in the USA or Canada, participants must be at least 21 years old.

  • BetBrain employees, affiliates, representatives, subsidiaries, holding companies, advertising agencies, or any other companies or individuals who are involved with the execution, production, distribution, or design of the Games, as well as their household members and immediate family members, are restricted from prizes.

  • Confirmed email addresses are the only ones eligible for prizes.

  • A maximum of one registration per IP is accepted.

  1. Customer Eligibility Requirements

The following criteria must be met by the participants in order to qualify for participation:

  • Individual participation is required since Companies and other legal entities are restricted from holding an account with us.

  • Age of Majority: You must be of age (majority) according to the laws of your home jurisdiction.

  • Documentation: You must agree with our documentation, which includes the Terms & Conditions, Privacy Policy, and Responsible Social Gaming Policy.

  • Single Account: You must not possess more than one (1) account or be a former account holder whose membership was terminated due to non-compliance with our terms and conditions.

  • KYC Compliance: Your account must be verified according to the Know Your Customer (KYC) program by providing all the requested information and documentation for the purpose of validating your identity.

  • No PEP Affiliation: Politically exposed persons (PEP) or family members and close associates of a domestic PEP cannot participate.

  • Permitted Territory: Your residency and physical presence must be in Permitted Territory (mentioned in the terms).

  • Banned Territories: Participation while located in a Banned Territory is restricted.

  1. Know Your Customer (KYC) Program

Since we maintain a KYC programme, we need to assess our customer base’s risk profiles. We may require your documentation to verify and refresh your personal information on a periodical basis. This will be according to our risk assessment. As such, the KYC procedures require the following:

  • The provision of valid government-issued identification (national ID card, passport, driving licence, etc.)

  • The verification process is completed whenever we request it.

  • The submittal of all required documentation within the requested timeframe.

  1. Restricted/Banned Territories

If the participants are from the following territories, their participation in any of our tournaments is specifically prohibited:

Kentucky, Idaho, Washington, Nevada (USA), UK, Australia, North Korea, Ukraine, Romania, Serbia, India, Malta, Montenegro, Netherlands, Netherlands Antilles, Antigua and Barbuda, and any other jurisdiction that the Company may periodically determine (‘Banned Territories’).

BetBrain reserves the right to modify this list at any moment, but it also cancels any prizes obtained by participants who are discovered to have accessed our platform while playing from Banned Territories.

  1. Tournaments Details

  • Scoring Mechanism: Our tournaments will use one of the scoring mechanisms listed below, which we will define and communicate before the start of each of our tournaments:

    • Max Multiplier: The highest achieved multiplier during a game spin will provide the points.

    • Profitability: The overall profitability during the tournament’s duration will provide the points.

    • Activity: The total number of spins completed over the course of a tournament will provide the points.

    • Mix: Points will be provided by a mix of the mechanisms mentioned above.

  • Daily Participation: Points can be accumulated on a daily basis according to the tournament’s scoring mechanic.

  • Leaderboard Restriction: In the event that a player has multiple accounts, they will not be able to win more than a single prize on the leaderboard.

  1. Prizes and Notifications

  • Notification: We will notify the winner via email and must receive a confirmation from them within 7 days. Any confirmation sent after 7 days will not be taken into consideration.

  • Payment: We will transfer the prizes according to the method mentioned in the tournament’s terms.

  • KYC Requirements: We will give away prizes according to the completion of a handover-acceptance report, which is contingent on the completion of the KYC process.

  • Organiser’s Rights: We, as the organiser, reserve the right to disqualify participants who violate the specified terms and conditions or are discovered to have acted in a fraudulent manner.

  1. Prize Claims and Limitations:

  • Prize Limitations: As the organisers, we do not assume any responsibility for any flaws or issues with the prizes.

  • Return of Prize: We, the organiser, reserve the right to reclaim any prize (or its equivalent) and any incurred expenses in case a participant is discovered not to meet the terms and conditions.

  • Dispute Resolution: The organiser’s decision is final in the event of any dispute.

  • Unawarded Prizes: Any unawarded or unclaimed prizes will remain in possession of the organiser. They may be disposed of at the organiser’s discretion.

  1. Consent to Data Processing

Participants will consent to the processing of their personal data by providing the necessary information to claim their prize. As the organiser, we will keep this data and specifically comply with Law no. 190/2018 of Regulation no. 679/2016.

  1. Game and Participation Disclaimer

  • No Real Money: No actual money is necessary for gameplay. Neither the Games nor the Website offers real money gambling.

  • No Necessary Purchase: Neither entering nor winning will require any purchase.

  • Void Where Prohibited: When prohibited by the law, the competition is void.

  1. Complaints and Disputes

Complaints regarding the campaign operations can be sent to [email protected] or [email protected]. 

The organiser will not entertain any prize-related complaints after the signing of the handover-acceptance report.

  1. Force Majeure

In the event of a force majeure (as defined by applicable laws) or in circumstances that go beyond the organiser’s control, this campaign may cease immediately.

  1. Amendments

BetBrain reserves the right to modify the campaign terms and conditions at any time without any prior notice.

  1. Tournament-Specific Terms

The specific tournament terms prevail in case there is any inconsistency or conflict between the general terms and conditions and the specific terms of a tournament. The generic terms are immediately overwritten by the terms of a particular tournament when specifically stated.

Additional Terms

  1. Liability Limitation

We, as the organiser, are not liable for any damage, injury, or loss caused by the use of the platform, tournament participation, or technical issues. Examples include platform malfunctions and internet outages. Any risks associated with participation are assumed by the participants.

  1. Fraud Prevention and Participant Responsibility

In case a participant engages in any attempts to manipulate, tamper, or exploit the results, platform, or tournament through unethical, fraudulent, or illegal methods will trigger effects like immediate disqualification, prize forfeiture, and potential legal action. Fair play standards and acting in good faith must be adhered to and respected by the participants at all times.

  1. Intellectual Property

The organiser owns all the designs, trademarks, intellectual property related to the tournament and platform, and logos. No participant may use, distribute, or reproduce this content without any prior written consent.

  1. Termination of Participation

A participant’s access or participation in any tournament can be terminated or restricted at the organiser’s sole discretion in case of any breach of these terms or inappropriate behaviour. In these cases, there will be no due prizes or compensation.

  1. Tax and Legal Responsibilities

Any legal obligation related to the winnings or tournament participation is solely the responsibility of the participants. No amounts will be withheld by the organiser unless the law requires it.
